TERMS OF SERVICE!

COPYRIGHT, MERCH, ARTIST AND CUSTOMER RIGHTS

You, the customer, are allowed to:

  • Use art for personal purposes.

  • Add the art to TOYHOUSE. (with their respective credits to the artist, TOYHOUSE name MagikalDelirium)

  • Use the art as Twitch emotes, decoration for profiles and profile photos.

  • ALWAYS REMEMBER TO LEAVE CREDITS TO THE ARTIST.

You, the customer, are not allowed to:

  • The use of the product as an NFT is strictly prohibited.

  • Re-sell the product.

  • Use the product for monetary profit and/or merch without reaching an agreement with PAN1K.C0, the artist.

  • Claim the product as of your authorship.

If the client breaks or ignores any of these rules, I, the artist and creator of the product, have the right to prevent the use of the product and add the client to a blacklist.
If needed, the artist will issue a DMCA takedown notice (Digital Millennium Copyright Act).

I, MagikalDelirium, the artist, I'm allowed to:

  • Use the commission as a part of my portfolio and/or as an example of my commissions' list, unless otherwise specified by the customer.

I'm not allowed to:

  • Use the final work in my own merch or re-sell the piece.

ONCE THE CLIENT AND THE ARTIST HAVE REACHED AN AGREEMENT AND THE COMMISSION IS IN PROGRESS, THESE TERMS WILL AUTOMATICALLY APPLY, EVEN IF THE THE CLIENT HAVE NOT READ THESE TERMS.

COMMISSIONS PRICES AND INFORMATION!

Things to keep in mind:

  • I only accept PayPal or Argentine money.

  • The client must make the first half of the payment after the sketch, and the other part of the payment at the end of the commission.

  • I don't do refunds after the sketch is approved.

  • The commissions are ready in a period of one week, but the time can vary depending on the complexity, quantity, and people on the waiting list.

  • REMEMBER TO READ THE TOS, IT WILL APPLY EVEN IF YOU DONT READ IT.

PRECIOS DE COMISIONES E INFORMACIóN!

Cosas a tener en cuenta:

  • Solo acepto PayPal USD o plata argentina.

  • El cliente debe pagar una seña (la mitad del trabajo) una ves apruebe el boceto, luego deberá pagar la otra mitad una vez finalice.

  • No hago reembolsos una vez el boceto esta aprobado.

  • Las comisiones normalmente tardan un periodo de una semana, pero el tiempo puede varias según la complejidad, cantidad de trabajo, y que lugar de la lista de espera tienes.

  • RECUERDA LEER LOS TERMINOS DE SERVICIO, ESTOS SE APLICAN INCLUSO SI NO LOS LEES.

  • En el caso de argentina, los precios están ajustados para ser más accesibles.

TERMINOS DE SERVICIO

COPYRIGHT, ARTICULOS DE MERCH, DERECHOS DEL ARTISTA Y EL CLIENTE

Usted, el cliente tiene derecho a:

  • Usar el arte con propósitos personales, no de lucro.

  • Añadir el arte a la pagina TOYHOUSE dandole creditos a el artista. (Nombre de TOYHOUSE: MagikalDelirium)

  • Usar el arte como foto de perfil, decoración de perfil o emote con los respectivos créditos.

  • Siempre debe darme los créditos usando el arte en un espacio publico.

Usted, el cliente, no puede:

  • Utilizar el producto como un NFT o para lucrar, queda estrictamente prohibido.

  • Revender el producto.

  • Usar el producto como merchandising (ej: imprimirlo en camisetas y venderlo, venderlo como sticker, etc) sin hacer un acuerdo previo con la artista, MagikalDelirium.

  • Reclamar la total autoridad sobre el producto.

Si el cliente ignora o inclumple una de estas reglas, yo, la artista y creadora del producto, tengo el derecho de prevenir el uso del producto y añadir al cliente a una lista negra.
Si es necesario, la artista tomara acciones de DMCA (Digital Millennium Copyright Act) (Reclamo por copyright).

Yo, MagikalDelirium, la artista, tengo derecho a:

  • Usar el producto en mi portafolio o como ejemplo en mi listado de comisiones, a no ser que el cliente haya pedido lo contrario.

Yo, MagikalDelirium, la artista, no puedo:

  • Usar el producto en merch o revenderlo.

UNA VEZ EL ARTISTA Y EL CLIENTE LLEGAN A UN ACUERDO Y LA COMISIÓN EMPIEZA, ESTOS TERMINOS SE APLICAN AUTOMATICAMENTE, INCLUSO SI EL CLIENTE NO LOS HA LEIDO.
